Ik verzend al meer dan 30 jaar via Postnl en laatste jaren ook via DPD. Mijn ervaring , ook als ontvanger , afkloppen , is goed. Als je als verkoper goed verpakt , duidelijk adresseert , voor jezelf foto s maakt van items voordat ze het pakket ingaat en het gesloten pakket, dan gaat het best goed. Ik heb voor het eerst te maken met een beschadigd pakket , 99% zeker veroorzaakt door postbezorger. Stevig brievenbuspakket gekraakt en ook de stripboeken. Moet je een olifant voor geweest zijn......
Dan begint het spel met de post, indienen klacht, claim en dan kom je er achter dat verzekerd pakket van antieke items een wassen neus is, al kan je een marktwaarde aantonen. Postnl gaat uit van aankoopbonnen van de verkoper ( de verkoopsom is niet relevant) DPD gaat uit van bij toekenning claim hooguit een paar euro per kg. Hoe beslagen ten ijs je ook als verzender bent.
Ergo, wat vermoedelijk voor velen geen nieuws zal zijn, als je iets waardevols verkoopt en de post zit er tussen en er gaat iets mis dan zijn koper en verkoper afhankelijk van willekeur van het postbedrijf, hoe de pet staat versus hooguit mogeljke uitkeringscoulance. Als koper ben je afhankelijk van de verkoper of die een claim wil indienen ( zeker als de verkoopsom al betaald is ) als verkoper heb je de koper nodig om een gedegen claim in te dienen.
Mijn conclusie , hoe meer waardevol hoe beter toch maar af te halen of af te laten halen.

Ergo, which probably will not be news to many, if you sell something valuable and the mail is in between and something goes wrong, the buyer and seller depend on the arbitrariness of the postal company, how the cap is versus at most possible payment leniency . As a buyer you are dependent on the seller or who wants to submit a claim (especially if the sales price has already been paid) as a seller you need the buyer to submit a solid claim.
My conclusion, the more valuable the better to collect or have it collected.

Dat doet me eraan denken dat jij een mail hebt verzonden aan Catawiki inzake de postwet. Drie keer raden wie die in zijn mailbox kreeg... (;-) Catawiki heeft blijkbaar geen interesse...

Dit fenomeen is helaas al net zo oud als er pakketten worden verzonden. Indien je al 30 jaar zonder problemen wat verzonden en/of ontvangen hebt, moet je je handen dichtknijpen. Hier zijn al vele discussies over gevoerd, maar ook hier geld Cruijff zijn wet: Elk voordeel heeft zijn nadeel. Vooral dankzij de steeds brutaler wordende fraudeurs, worden de spelregels steeds strakker getrokken door de transportbedrijven. Hierdoor moeten de goeden onder de kwaden lijden.
De conclusie van Harry56 is juist, maar ook hier heeft dit voordeel een nadeel: Het item is dan minder aantrekkelijk voor vele bieders en daarom zal de opbrengst meestal lager zijn.

Arco en Tammo, ik heb inderdaad "geluk " dat ik niet eerder postperikelen heb gehad, ik ben van mening dat zorgvuldigheid van verzending een hoop ellende heeft en kan voorkomen. Ook ingeval je koopt een must eerst contact te hebben met de verkoper dat die in ieder geval ook zorgvuldig is met verzenden.
Ik vond het weer eens tijd om uit te zoeken wat nu het ' actuele " recht bij verkoop tussen particulieren onderling is. Ik heb wat meer tijd dan de werkenden dus het was weer een "interessante "speurtocht" van dagen . Kan ik een boekje over schrijven dat instanties waar je van verwacht kennis in huis hebben ....dat dus niet hebben en net als helaas Catawiki veilingen ( ik vind dat wel triest ) niet belangstellend zijn, ook niet fraai als het emailtje bij Arco wordt neergelegd en dat niet wordt verteld. Anyhow maakt niet uit , via respectievelijk consumentenbond ( lastig/moeilijk/ weet niet, naar Rijksoverheid Post, lastig niet ons loket , verwijzing naar ACM consuwijzer , niet ons loket , verwijzing naar juridisch loket , van diverse personen andere antwoorden , echter uiteindelijk wel verwijzing naar een advocatenkantoor die er in het verleden en actueel de tanden in heeft gezet. Prima adres met links die ik mag plaatsen voor een ieder die het nuttig vind.
Wijzigt overigens niet aan het feit dat verkopen en verzenden met de post of een veilinghuis er tussen voor koper zowel als verkoper nooit zonder risico is.
Maar wel prettig dat de particulier voor 95 % met advocatenvoer kan weten wat het recht en de wet is, met zeker nog een grijs gebied en "zie je recht maar te krijgen ............" En zoals Tammo schetst gezien het aantal frauduleuze claims wordt het de postbedrijven inmiddels ook steeds lastiger gemaakt de bedrijfsvoering fatsoenlijk uit te oefenen.

Arco and Tammo, I am indeed "lucky" not to have had any postal problems before, I believe that due care in shipping has and can prevent a lot of trouble. Even if you buy, it is imperative that you first contact the seller that he or she is in any case carefully sent.

Nog aanvullend wat Ictrecht mij via email nader heeft toegelicht :
In de Postwet wordt overigens in artikel 29 inderdaad duidelijk bepaald dat het postbedrijf nooit aansprakelijk is voor (schade als gevolg van) verlies, beschadiging of vertraagde aflevering, behalve als het postbedrijf bewijsbaar opzettelijk of grof nalatig heeft gehandeld. Ook kan alleen de verzender een claim indienen. Deze artikelen zijn niet in de wet opgenomen ter bescherming van consumenten (of andere groepen burgers), maar om ervoor te zorgen dat postbezorgdienst in Nederland mogelijk is en blijft. De gedachte is dat geen enkel bedrijf deze taak op zich zou willen nemen als postbedrijven constant overspoeld zouden worden met claims over vermiste/beschadigde brieven en pakketjes.
