Dear Scam, First of all, it is totally irrelevant to Catawiki what the Belgian law says, as the Catawiki is located in the Netherlands and must adhere to the laws of that country.Second, there is no definition included in Belgian law of what constitutes healing. jurisprudence (explanation by judges what exactly is meant, the intention of the law) explicitly refers to stolen goods, not spiritual creations and fourth and last you again confuse trademark and copyright a common mistake

As you noticed above I am not a jrist :-), and the following is a far side, but just an answer:

Mmn would it be illegal are to offer illegal copies of an illegal comic book as original illegal copies? And who will you complain of to the maker of the original of which there is an illegal copy of which you have made an illegal copy or does the copyist feel that his copyright is infringed because he is being copied? Interesting cost for a copyright lawyer

Imagine: I'm selling my own translation of Harry Potter (illegal, because I don't have the rights); if you then make copies of that translation (without my permission) and sell it too, then you are infringing my copyright (and Rowling's of course).

The comparison with "real" goods might make it clearer: if you steal my supply of heroin, you are a thief and punishable by law, even if I am not allowed to possess heroin.

If the first illegalist of course had zero creative input, a copy of his work is really just a copy of the original work and only the original author has suffered damage.

Tacozip is Belgian just like me and unlike Catawiki and you have to comply with Belgian laws. In Belgium, fencing is everything that has to do with trading goods obtained through crime and that implies counterfeiting.

And for the Netherlands I don't know yet . Moulinsart has apparently discovered the Netherlands, beware!

Case law, literally a legal conception, is the entirety of judgments made by (Dutch) courts. Jurisprudence is therefore a collective term.

Catawiki, can nothing really be done about this?

http://veiling.catawiki.nl/kavels/1049620-dat-wordt-een-kampioen- advertising-issues-sc-1st-edition-2012

Not only is it ridiculous that of this comic book that was supposedly made on 35 copies, there have already been 5 auctions at Catawiki in less than two years, but what argument are you going to come up with this time to continue offering this illegal (and as indicated in Catawiki) item at your auctions?

In case the external link is telling the truth, don't put this "trial album" in another (not illegal) series ?

That external link doesn't say that the album with that cover exists, just that that cover was initially used for the announcement.
It's quite conceivable that someone produced some counterfeits based on that digital image. It is much less likely that Standaard would have rejected the cover after everything had already been printed.
But that can only be determined with certainty if you can put both editions side by side to assess the quality of printing and finishing.

Boekenmagazijn

Now it says "With original cover drawing.
Only a few put into circulation"

Even though the album is in the series "illegal" the text is still not really perfect . Wouldn't an explanation be better as you put it? Then (I think) without the word forgery, possibly home industry. Unless, by definition, we see something like that made to sell for a high price. But show that ...

The link says this: " As with the previous albums in the series, the cover drawing of the album that was shown at the announcement was not final. redrawn to better match the course of the story.
The final version was first shown in June 2014 on the site of Studio Vandersteen. "

If previous albums (I don't know which one is referring to) are given the same authenticity and this is not it, then there are more of those home crafts in circulation. I do not know this Suske Wiske site, perhaps it is even better to make contact how one arrives at that certainty of "original".

As you probably know, I visited Leen Vandersteen in October.
There I asked her why there were sometimes two versions. According to her, it often happens that a proof of 2000 copies is made and then it is decided to use a different cover.
A well-known example #1337621

You got it from a source that should know something like this, but you don't have 2000 printed as a proof, do you? I can imagine that, for one reason or another, Standaard and/or the illustrators don't like a first-chosen front cover illustration. And would those 2000 have gone into the paper mill? because only a few are in circulation with the catalog copy? Still an elusive thing.

What is the difference between 20 printings and 2000 printings?? Only put more paper and the current printing presses for only a few copies they no longer do (I think). Know that many of those printed ones disappear via all kinds of employees, but I doubt that there are only a few

I'm not convinced.
With current digital printing techniques, good forgeries are fairly easy to make, but often you have to work partly with scans of lower resolution, and you can see the difference. In addition, a regular copy will be used for the inside of a pirated version and that must always be trimmed so that the book becomes a fraction smaller.
But as mentioned, you should see the two versions side by side.
